The Employment Rights Act is moving into its next stages like a juggernaut and cannot be avoided. There are changes taking effect in April 2026, including reforms to Statutory Sick Pay, Paternity Leave and Unpaid Parental Leave, whistleblowing protection for sexual-harassment disclosures, and increased protective awards in collective redundancy cases. Additionally, the Fair Work Agency is due to be established from 7 April 2026, with a wider enforcement role being phased in over time, including in relation to holiday pay and Statutory Sick Pay. Employers may face penalties or other enforcement action for breaches.
