We have not come across anyone yet being fined for breach, but there is an initiative to ensure that employers are compliant with work permits and all the compliance associated with rights to work. We have recently come across clients who have not even checked this obligation i.e. for an individual to work legally in the UK. If it’s not on your checklist for recruitment then it needs adding and can take place even before employment starts and prior to induction.
